Howard’s conclusion?

It appears that the Texas Gun Show event in north Austin was cancelled because:

·      The promoter didn’t follow the rules he originally agreed to.

·      After TGS agreed last week to uphold the sublease agreement, sales by unlicensed dealers continued inside the venue.

·      Another illegal alien was arrested for buying a firearm.

·      Because of prior public notification, a private gun seller is now at risk of federal prosecution.

·      HEB, being ultimately responsible to abate the nuisance created by the previous year’s illegal activity, acted to protect their interests, as any responsible company would.

  1. I think there is a problem with terminology here. An unlicensed dealer, is a separate entity from a private sale. An unlicensed dealer, is illegal, period. Technically, there are multiple steps to be considered a dealer, by the BATF(U). To be considered a dealer, the most important aspect is that your purchased a firearm, with the sole intention of turning around and selling it for a profit.

    Individual or private sales, are not DEALERS, they are private individuals. What the BATF(U) is doing here is bending the definition of “dealer”, which they have gotten away with, since the Clinton administration. I personally, would like to see them sued and the definition officially settled, WITHOUT this interpretation wiggle room the BATF(U) has.

    Now, the ultimate question, are people being investigated for being illegal, unlicensed, dealers. OR is this really an attempt to limit all private transactions by Austin Officials in conjunction with the jack-booted thugs of the BATF(U)? I’m asking, because by all accounts this is still not clear.

    • Good question.

      The impression I received is an attempt to crack down on illegal sales. That is, a seller knows or is given reasonable suspicion that the sale may be illegal but makes the sale anyway… and of course, a person that is unable to legally purchase a firearm is attempting to find a way to obtain a firearm.

      Of course is it more than that? Hard to say. We only have one data point, so we just have to keep our eyes open.
