An 85-year old man here in Austin was just arrested for firing upon city (contract) workers.
Apparently the workers were doing some tree trimming, this man thought they were trespassing, and fired 5 shots at them (claimed 3 were warning shots).
- Regardless of legality, trespassing is not enough reason to use deadly force.
- If you have to shoot, it’s because your life (or perhaps someone else’s) is in danger.
- If someone’s life is in danger and thus you have to shoot, warning shots are not what you fire.
This was irresponsible gun handling and irresponsible situation handling. Armchair quarterbacking this, if you didn’t want to confront the individuals, calling the police to have them look into it would have been the better thing to do.
Unfortunate that this reflects badly on the rest of us.
I have to wonder if, given his age, he doesn’t suffer from reduced faculties.
Unfortunately it does.
I did wonder if that might be the case, but that’s something that’ll have to be determined in the course of judgement.
